All Med Pro can provide dentists with contract certain occurrence or claims made based indemnity cover with comprehensive support from fellow dentists starting from £1,695.00 per year, inclusive of insurance premium tax.

Occurrence based indemnity

Outside of the discretionary dental defence organisations the providers in the insurance market usually offer cover on a claims made basis. Claims made means that cover would only be in force whilst the policy was active. But what happens if a claim is made against you many years after the policy expires? Well, unless you have adequate run off arrangements you would be left without cover and often run-off cover is capped to a maximum number of years and for specified circumstances such as retirement and death only.

Like the dental defence organisations, All Med Pro now provides claims occurrence based indemnity, which simply means that as long as you were insured with us when the treatment was provided then cover will always apply, irrespective of when the claim is made – which could be many years into the future!

This means that in the event of long-term sickness, retirement or even a career break, cover would be in place indefinitely for the treatments you performed whilst being insured with All Med Pro under our claims occurrence policy.

Discretionary cover versus contractual cover

The majority of dentists have chosen to obtain cover through the traditional medical defence organisations (MDOs). The cover provided by those organisations is usually provided on a discretionary basis. Because the cover is discretionary there is no guarantee that a claim will be paid and we have heard from numerous clients that this has happened to them. It is worth noting that if your indemnity provider refuses to provide you with cover it does not mean the patient’s claim ends there. It simply means you are left to personally cover all legal costs and compensation if awarded. You wouldn’t choose to cover you house or car this way and it seems like a high-risk approach for dentists to protect themselves.

All Med Pro provides contract certain indemnity cover. A policy is issued to the dentist which is a contract between the dentist and the insurer and is legally enforceable. Policy terms and conditions are in place to protect the insured individual and not to give the insurer room to avoid paying the claim. There are many ways that insurance customers are protected against this with numerous rights of recourse available if required. An insurance broker is regulated by the Financial Conduct Authority and insurers are also regulated by the same body and in addition the Prudential Regulation Authority. This requires that:

  • The practitioner (as a customer) is treated fairly
  • The insurer must have adequate funds to meet all liabilities
  • A formal complaints service must be available
  • Access to the Financial Ombudsman Scheme is available if a dispute should arise with the insurer
  • Access to the Financial Services Compensation Scheme is available if an insurer should fail (which in the context of medical malpractice insurance would be a very rare event).

Contract certain indemnity provides you with a clear understanding of what is covered in the event of a claim and avoids the reliance on discretionary indemnity. As long as full disclosure, particularly regarding scope of practice and claims history, has been given the claim will be covered contractually.
